# Refund Policy

## Article 1 (General Provisions)

This Refund Policy governs matters relating to refunds for paid purchases of the Rulyfi service (the "Service") operated by rulyfi (룰리파이) (the "Company"). Users are deemed to have fully understood and agreed to this Refund Policy prior to making any payment.

## Article 2 (Immediate Provision of Digital Content and Limitation on the Right of Withdrawal)

1. The Rulyfi paid Service is a Software as a Service (SaaS) offering in which **use of the digital content commences immediately upon completion of payment**.
2. At the time of payment, the User agrees to the following:
   - Express consent to the digital content being provided immediately upon payment;
   - Consent to the limitation of the right of withdrawal (cancellation of the order) and to obtain a refund after the commencement of use, pursuant to **Article 17(2), Subparagraph 5 of the Act on Consumer Protection in Electronic Commerce (전자상거래 등에서의 소비자보호에 관한 법률)**.
3. In order to satisfy the trial-use obligation under Korean law, the Company permanently provides a Free tier (free trial version). Users may try out the core features of the Service in advance on the Free tier before proceeding with a paid purchase.

## Article 3 (Principle of Non-Refundability)

**Refunds are, in principle, not available for the following reasons**:

1. The User's mere change of mind;
2. Commencement of use after a new payment (i.e., logging in / running the scanner / using the builder, etc., one or more times);
3. Where the User has commenced use of the Service after automatic renewal (i.e., logging in, running the scanner, using the builder, etc., one or more times after renewal); provided, however, that where the User has not used the Service at all after automatic renewal, a refund may be obtained pursuant to Article 4, Subparagraph 4;
4. Mid-term cancellation of a subscription (i.e., upon cancellation, the Service remains available through the end of the remaining billing cycle; no pro-rata refund);
5. Where the Company has suspended or terminated the account due to the User's breach of the Terms of Service.

## Article 4 (Exceptions Where Refunds Are Available)

A refund or extension of the subscription period is available only in the following cases:

### 1. Service Defects (i.e., Attributable to the Company)

- Downtime of 24 hours or more: where a core service (scanner, builder, automated trading bot) fails to operate normally for 24 hours or more;
- Failure of a core function: where a defect is not resolved for 24 hours or more;
- Criteria for determining a defect: based on the Company's operational monitoring data (i.e., AWS / Supabase / Cloudflare status pages plus the Company's own monitoring system);
- Minor UI bugs, temporary defects in certain functions, and outages of external exchange APIs do not constitute defects.

Processing flow:
- The subscription period is automatically extended by the duration of the defect (i.e., no refund; compensation of equivalent value);
- Where the User expressly requests a refund and the defect meets the SLA level (24 hours or more), a refund may be considered.

### 2. Payment Errors (i.e., Attributable to the Company or the Payment Service Provider)

- Duplicate charges caused by a Company system error;
- Errors in the payment amount;
- Defects in the payment authentication flow.

### 3. Refunds Mandated by Law

Where a refund is mandated under applicable laws and regulations (i.e., the mandatory provisions of the User's country of residence shall prevail).

### 4. Non-Use After Automatic Renewal (i.e., Withdrawal of Offer)

Where, after an automatic renewal payment, the User has not used the Service at all (i.e., no logging in, running the scanner, using the builder, etc.) and makes a request within 7 days from the renewal date, the right of withdrawal and a refund are available pursuant to Article 17 of the Act on Consumer Protection in Electronic Commerce (전자상거래 등에서의 소비자보호에 관한 법률).

## Article 5 (Refund Application Process)

1. Refund applications are received at [email protected].
2. When applying, please include the following information:
   - The payment email address;
   - The payment amount and payment date;
   - The Payment Service Provider's payment identifier (found on the receipt);
   - The reason for the refund request.
3. The Company will notify the User of the results of its review within 7 business days after receipt.
4. Where a refund is approved, the refund will be processed through the Payment Service Provider within 14 business days.

## Article 6 (Discretionary Refunds by the Payment Service Provider)

1. Rulyfi paid purchases are processed through a Payment Service Provider (Merchant of Record).
2. The Payment Service Provider may, in its discretion and in accordance with its own refund policy, decide to grant a refund irrespective of the Company's decision to deny a refund. This is a matter beyond the Company's control.
3. The Company shall bear no separate liability for the Payment Service Provider's discretionary refund decisions.

## Article 7 (Advance Notice of Automatic Renewal)

1. For automatic renewal payments of subscription-based paid services, the Payment Service Provider sends the User receipts, renewal schedule notices, and the like.
2. A User who does not wish to have an automatic renewal may cancel the subscription before the next payment date.
3. Where an advance notice of automatic renewal has been duly sent but the User fails to review the notice, the Company shall be deemed to have validly given such notice.

## Article 8 (Precedence of Mandatory Provisions of the Country of Residence)

**Where mandatory consumer protection provisions of the User's country of residence confer stronger refund rights than this Refund Policy, those provisions shall prevail over this Refund Policy**.

## Article 9 (Amendment of the Refund Policy)

1. This Refund Policy applies from its effective date, and in the event of any amendment, the Company will give notice through announcements within the Service beginning 7 days before the amended provisions take effect.
2. In the case of an amendment unfavorable to Users, the Company will give notice beginning 30 days before it takes effect and will individually notify Users at the email addresses they have registered.
